In Part 2 of the interview  Hill looks at the current state of construction defect litigation.

Construction defect litigation and issues concerning insurance are described in this part of the interview.

‘In simple terms, the requirements for resolution in a typical construction defect case fall into to four categories, according to Ed Martinet, president of LiMa Solutions, Inc.:

  • Technical Issues – What are the actual construction conditions that need to be addressed? What caused these conditions? What is the result of these conditions? How should these conditions be addressed and how much will it cost?
  • Legal Issues – What are the legal implications for the various parties? What is the legal standing? What laws apply?
  • Coverage Issues – What is included and what is not included in the terms of the applicable insurance policies?
  • Other Issues – Outside of the technical, legal and coverage issues, what are the other issues that need to be addressed? According to both Martinet and Viau, often these “other issues” carry significant weight in the resolution of a case. Viau gives the example of a situation where the homeowner despises the builder so much, that resolving the case is nearly impossible.’
